Reconhecimento pessoal como meio de prova: o racismo estrutural (re)velado nos instrumentos de justiça brasileiro.

Abstract

This research aims to analyze personal recognition as a means of proof and its reflection in the strengthening of structural racism as a result of procedural informality and non-compliance with the normative guidelines provided by the authorities responsible for carrying out the act that culminate in the massive incarceration of young black and poor people in Brazil . The general objective of this research is to observe the way in which structural and institutional racism influences the act of personal recognition as a means of proof in criminal proceedings, so that non-compliance with the prescribed procedures has resulted in the unfair conviction of thousands of innocent black people in the country. Thus, a quali-quantitative approach is used, through the dialectic method, using bibliographical research to show that in Brazil, the criminal has color and etiquette and that the very institutions that guarantee justice and hold the power of the State fortify segregation and increase social inequalities due to historical-cultural conceptions arising from the secular slave regime in Brazil.
