Abstract

This monograph materializes in the theoretical field of Civil Law, but specifically in the field of Family Law, whose theme will be to analyze the effects, validity and legal effectiveness of the dating contract in the face of the reality of the facts, as well as its reflections in today's society. and application in the legal system. The objective is to understand how the dating contract is made and how it can be constituted, as well as its validity and legal effectiveness and whether or not it will be beneficial to the parties, its characteristics and requirements. The research will be developed from the deductive method, whose hypothesis will be: legal effects of the dating contract, as well as its validity and effectiveness in the face of the reality of the facts. It will have a qualitative approach and will use as instruments: the bibliographical research, which the search is made through the Google Scholar tool using the search terms: dating contract, jurisprudence, scientific article. In addition, the evolution and current situation of the dating contract in society will be addressed, seeking to demonstrate the validity and effectiveness that the dating contract can provide to the parties according to the reality that the couple is inserted. At the end of the work, it was possible to understand and clarify when and how the dating contract should be used, as well as clarifying its effectiveness and validity requirements.
